Exactly how does a convicted human smuggler qualify for a LEGAL worker's visa anyway?

Castellanos was inside a vehicle and leaving the home when deputies arrived. When deputies searched the car, they found Castellanos with the assault rifle, a handgun and 120 rounds of ammunition, the sheriff said.

What in the name of hell is the US doing granting a worker visa to someone who has been arrested/charged with human smuggling?
Is this another case of worker visas for "doing jobs Americans won't do"?
