And yet I wonder.. why should the children be penalized for their parents actions. Their only fault was being born in the U.S? I'd rather have them in school and become educated Americans rather than running around shooting others with guns.

No one is saying they can't go to school but you have to in fact establish residency to get that special rate. I can't go to a state I am NOT a resident of and get that rate, why should they be able to?
So someone who was born and lived in Virginia all their life, is not a legal resident and won't be until they are 24, if their parents came here illegally?
What purpose does this serve really, I mean this kid Lopez is a citizen what does his Parents have to do with residency in-state?
Most state statutes require proof of legal residence over a period of time (usually one year before admission).

I have to side with Exedous and Mach50 here on this one.
Unless/until the Anchor Baby loophole is closed on a Federal level; I will have major heartburn with denying 'birthright' citizenship to a child born here------even if both parents are illegal.
Read that using; say July 1st, 2008 as an arbitrary cutoff date, grandfather Anchors born prior to that date in whereas the kids born after June 31st, oh well. Again; such a ban would only apply IMHO if both parents are here illegally.
And Andrea Leeds Armstrong, of the university's committee on Virginia status, said last week after reading the memo, "I'm glad this decision came down," clarifying that students could make their own case separate from their parents. "Let me just say, I'm really happy to get this advice." This week, the university asked Lopez to reapply for in-state tuition.
This decision was made by the state attorney general, and i guarantee it will be struck down if they take it to court. The kid should contact the ACLU about his situation. This law will not prevent any "anchor" baby from getting instate because of the loophole about student making their own case separate from their parents. I truly believe the attorney general is doing it just to satisfy the anti- immigrant crowd out there.
