They are not denying that they are illegal and using stolen IDs. Rather, that they were already employed, which they feel should exempt them from the “new hire” E-Verify requirement. If they win this case, it will be yet another loophole to facilitate illegal immigration.

My company is instituting E-Verify since we work on federal projects. ALL employees are subject to verification no matter when they were hired. That's the word from our HR department. I don't know if that's the law or we are just going a step further than is required...

Assuming they couldnt fill the job with a legal citizen how does employing a non citizen with 4 kids contribute more to the economy than what she receives in financial assistance for the kids.

Federal contractors are required to use E-Verify on all employees. Apparently, in IL they can only use E-Verify on new hires at companies that don’t have contracts with the government. Illegals hired prior to E-Verify are essentially given a free ride.
