I don't see a real concern here. You have to file your taxes in order to take advantage of the mortgage tax credit. I don't know anyone who is undocumented who files their taxes. If they did they'd be filing them for whoever's ID they are using, which would be pretty pointless.

This type of tax fraud could be avoided by requiring tax preparers to use E verify or another type of ID check to match the name, SSN, date of birth and gender before being allowed to prepare the individual's taxes.
