Roxana Orellana Santos is suing Jenkins, Deputy Jeffrey Openshaw, a deputy who is referred to as John Doe, the Frederick County Commissioners, and three current and former individuals with U.S. Immigration and Customs Enforcement. The suit claims she was unlawfully arrested and the deputies violated her civil rights.
The suit asks for $1 million in compensatory damages. The 27-page document was filed Tuesday in U.S. District Court in Greenbelt on Tuesday.
The lawsuit claims Orellana Santos was "quietly eating her lunch and looking out onto a newly built pond behind a row of stores" near Evergreen Square on Buckeystown Pike on Oct. 7, 2008.
Jenkins said his two deputies were on patrol behind shopping centers on Md. 85.
He said that when Orellana Santos saw the marked cruiser approaching about 100 feet away, she ducked quickly, grabbed her belongs and moved behind a shipping container. It was an obvious attempt to hide from view, Jenkins said.
The deputies asked for her name and identification, he said. During a routine check, they found she was wanted by ICE on a deportation warrant. She was then taken into custody.
Kind of like a bugler breaking in your house then complaining cause someone threw them out .What rites does anyone have that arn't legally here to start with . There is a bunch of fools need sent somewhere else . Trespassers have no rites
You know reading about this case just makes me sick! WTH is going on in this country where law enforcement are sued for doing their jobs within the laws of this country by illegal foreingers? These are the kinds of cases that really turn Americans against illegal aliens and erase any kind of sympathy one might have for them. It really is sickening what these pro-illegal groups are doing to help circumvent our immigration laws also. Why do they care so little for their own country and its citizens?

It is indeed sickening. This woman already had a deportation order. This should not even be an issue. You’re absolutely right; our law enforcement officers are being sued for doing their jobs, while illegals are laughing all the way to the bank. Yet, pro-illegals can’t understand why we’re angry and fed up.
There I was minding my own business breaking the law all by my lone some. bam Up walks some jack booted cops and they arrested me. Yeah I was wanted for other crimes, yeah I was breaking the law, but I didn't do nothin that deserved me being questioned at that moment so it aint fair.

I catch your drift loud and clear; apparently, US law does not apply to illegal alien losers.

I does but apparently if they are questioned it is called racial profiling.
