-- A Floyd County toddler suffered near-fatal abdominal injuries and his mother's boyfriend is charged with the crime.
Police said Juan Carlos Contreras-Juarez is an illegal alien and is charged with aggravated battery.
According to police, Contreras-Juarez was staying with the victim's mother when the incident happened.
The prosecutor's office described the 19-month-old's injuries as "extremely serious and disturbing in nature."
According to police documents, Heather Hutchins said her son, Ernesto Hernandez-Guzman Jr., was his "normal self" and had no "rash" when she left him in her boyfriend's care a week ago
Hutchins told investigators she left her Floyd County apartment for about 15 minutes on Jan. 7.
When she returned, her son was in bed for his nap.
According to police, Hutchins said that at around 7:30 p.m., she went into her son's bedroom and found him unresponsive, covered in vomit, and that he had a rash on his face, neck, and upper chest.
The boy was taken to Floyd Memorial Hospital by ambulance.

Its about time some part of Indiana did something about it. The mother should have been charged as well for aiding a fugitive. New Albany is an okay part much better than downtown. Downtown things like this happen all the time and nothing gets done bout it. Theres just too many illegals to keep in a jail.
And once again...someone who is not a taxpaying citizen will get a tax paid lawyer and court trial.

Ehhh.... I think that right is reserved for U.S. citizens who have a right to be here and get a fair trial with a state-appointed lawyer. Just goes to show you, "THIS IS NOT MEXICO!" Send his a** back.
Actually you're wrong - the law covers EVERY person in this country, regardless of immigration status.
The right to a fair trial is NOT reserved purely for US citizens - sorry if that offends you, but it IS the law here.
So then why don't they have the right to vote? Or the right to not have troops living in their house? Or they have the right to not pay taxes? Because they are aliens--they do not exist in the context of the citizenry of this country. They are here illegally.
Apples & oranges. The right to a fair trial if accused of a crime is a basic human right.
Let me ask you this - if someone who is NOT a US citizen commits a crime against you in this country, would you not want to see them "brought to justice" and be accountable for their crimes?
Then they would need to be tried here in an American court under American justice - which requires they have a FAIR trial which includes legal representation should they not be able to afford it. Now do you see?
I would have thought as an american you would be proud to be part of a country that upholds human rights, but apparently not.
