I live around the Bloomington-Normal Area in an newer subdivision. The developer for the neighborhood is charging an association fee even though he has stated there is no association, With few (< 10) homes built, I am not sure an association could be formed. There is a codes and covenant, but doesn't follow them himself.

I have been searching the internet for some time, but have not had any luck.

Does anyone know where I could find rules or laws around what developers and associations can and can not do?

When the subdivision was fromed and plated I believe the developer had to agree to certain conditions. Go to the courthouse downtown and see what you can find on the subdivision. He can assess HOA fees, but he needs to provide a copy of the HOA rules.

If you have a lot of money invested in your home, and you are concerned, talk to an attorney and don't put it off. Small easily resolved issues can snowball in a hurry.

Thank you for replying. Unfortunately the lawyers weren't too helpful and the city basically said to wait it out. There are codes and covenants filed with the city, however he doesn't follow them (even changing them whenever he feels like it). I was hoping to find some legislation to help. I did find a bill (SB3180), but it is for homeowners associations.

He has to follow city/county/state codes. He cananot change the codes. If he changes the covenants they have to be included with the subdivision plat. If you don't have an HOA and there are many empty, unkept lots, you need one. You and your neighbors may have to ban together. Go dig around in county records and see what you can find. It might be interesting and you'll learn something about how to research records and how the law works in your township.

Start with your Township Supervisor and County Fire Chief. They DO know the codes. PS: When you search for public information, you can always claim Freedom Of Information Act (FOIA).
