Hi,

I want to check that can I lease a one bedroom APT in CARMEL with my 5 months baby. Bcz she no where sleep in other bedroom.

can any one help me in this regards, to pay for 2 bedroom is more effortable bcz only husband works. Tell me as per Indiana LAW how many people can stay in single bed room.

My neighbor has a 1BR and there is a man, woman, and at least one child there. There has never been a problem.

Are they selling you on a place they can charge you more, or are they citing some kind of law that dictates what you have to do?

I don't think two adults and a baby meet the criteria for not being able to lawfully rent a one bedroom apartment. Eventually, the child will meet that criteria but I don't think at 5 months old they do.

Unless they can cite a law mandating you rent a two bedroom, then I call BS. In fact, if they refuse to rent a one bedroom to you, I wonder if you might have a claim against them under the Fair Housing Act - familial status discrimination. Not confident of that, though. I'd have to research it.

There is not a state law that dictates the number of inhabitants permitted per bedroom. This is based upon city codes. There may/may not be a Carmel code. Call the Carmel City hall about it. It can also be an individual apartment complex policy and would likely be legal.
