The turtles songs are being played on Sirius yes BUT THEY ARE DIGITAL CRAP and do not sound anywhere near as good as the ORIGINAL ANALOGUE music they made!!
I've never understood most of the download copyright on music. I can go to a store and buy a cassette tape of Johnny Cash.
It's legal for me to give my friends copies of the cassette that I paid for but if they themselves download the songs they are violation.
I've not followed the Turtles case but it seems they are the ones taking ....... to court.
So it's legal to visit sites that have child porn as long you don't download it? I don't personally do that but wonder about this hypocrisy. Because I wouldn't visit a shop that sold child porn and if I did I'd expect to be charged with a crime whether I bought something there or not.
You can't view an image unless your computer downloads it. From the viewpoint of the server, it is a request to send a resource/image. Doesn't matter what the client (browser) does with it afterwards. If you see it on your screen, the image has been downloaded, cached, and rendered on your screen
Often I hear of people (usually men) that get caught with child pornography. I was wondering if law enforcement is monitoring these sites to see who visits and what they do, why on earth wouldn't they shut the site down if in fact it is illegal (which it is). One word is all I can think of "Entrapment". I thought that in itself was illegal? It's a very grey area and somewhat like an undercover cop pretending to sell drugs on the street or a cop posing as a prostitute just to bust people.
Doesn't qualify under "entrapment".

In criminal law, entrapment is a practice whereby a law enforcement agent induces a person to commit a criminal offence that the person would have otherwise been unlikely to commit.
It is perfectly legal for an undercover cop to setup a sting as a drug dealer or prostitute. The person has to initiate the illegal activity... thus would have committed the crime whether or not the person was undercover or a real provider.

NO.
You broke the law by making copies of that cassette tape and distributing it to your friends. No difference if you digitized that tape and put it on the internet to be copied by your friends.
The only time you wouldn't be breaking the law is if you are the owner of the copyright of the audio on that cassette tape... no you are not the owner.
Whether or not the authorities will chase you down.. well .. that's a different story.

That article refers to having acquired the recording legally. If someone buys an audio tape they acquired it legally. Then to give to someone a copy of the audio is not illegal.

Incorrect.
The article refers to Sirius similar to radio and whether or not they have rights to rebroadcast (royalties). The post I responded to

You legally acquired a cassette containing copyrighted material. You did not purchase the right to the material (copyright holder) thus it is illegal to distribute (give copies to your friends).
Now if you recorded a song of your own creation on a cassette tape. You own the rights to that recording. You are more than within your legal right to make copies and distribute. In this case you are the copyright holder.
There is a difference between purchasing a copy of a copyrighted material versus purchasing the copyrights to the material. The medium, in your case cassette versus digital download, is irrelevant. This is the part you don't quite understand. if you acquired a recording legally, you essentially purchased the right to own that single copy with no right to distribute.
If memory serves, when cassettes came out, it was perfectly legal to duplicate you record collection as long as you were not profiting from it. I would assume copying images and other content from the internet the same rules would apply, copywrite or not. Of course if the content itself is illegal as is the case of child porn than that is a whole different enchilada. So no need to erase your HD's people!

Sorry, but no. It is common, but is not legal unless the material on the tape is public domain. The Sony decision created a grey area in regards to time-shifting. It recognized that when a member of a household used a VCR to record a show to watch at a later time, it was also understood that other family members and friends might watch that recording.
Copying and distribution (whether for pay or not) is pirating and illegal. Even libraries have restrictions in that they can lend a retail tape of the original, but not a duplicate.
