Copyright violations, illegal content, illegal statement by users, spam, porn. The website can and many times are held responsible for illegal activity on THEIR website.
There is a provision in the DMCA called safe harbor that exempts service providers from the actions of their users. The owner of this website should not be responsible if I upload a copyrighted file. The internet as we know it would grind to a halt otherwise. This would apply to ISP's, web sites etc. but you need to register as I already noted.
The flip side of that is the provider needs to act when someone files a DMCA notice, if they decline then they are exposing themselves to liability. The industry mostly polices itself, the copyright owner will often file the complaint with the host instead of the site owner. Any legitimate host in the US is quickly going to drop any site where it's clear they are engaging in illegal activity.
While the Pirate Bay was based overseas pressure from the US played a huge factor. You may be outside of the reach of US law enforcement but you're not outside of the reach of US government influence. If you want another example read up on DVD Decrytpter.
You're looking at such extreme situations. The U.S. government has not touched the vast majority of illegal operations on the internet. The reality is that there's no one policing the internet as a whole. There's pockets of interest from government agencies (child abuse and similar), but the majority of sites participating in illegal activity are not touched.

A site is going to have to have moderation......so many illegal things can go on, even above and beyond copyright violations.
I've been on unmoderated forums and they tend to be useless for civil discourse as all topics end up in chaos as the core group attacks anything anyone says,it ends up being a breeding ground for trolls.
Although City Data maybe a bit over moderated at times its much preferable to the anarchy of unmoderated forums.,
Get cheap hosting package for $5 a month and you can set whatever rules you want.
MyBB is easy stetup and free (I recommend version 1.6, less secure than 1.8 but at least it works). With WAMP (Windows), or LAMP (Linux) you could install Apache Server (home server). It will be online for free but that doesn't mean you'll get members.
Running a forum is a lot of work. And if you created one without moderators or rules, you would soon find the need for rules. People cannot be trusted. If you allow anyone to do anything then soon the lowlifes will run off all valuable contributors and you'll have a forum full of spam, flames, and all other despicable means of disrupting a community.
If all you want is to swear all you want, there are several adults only forums that are not related to sexual content. If content isn't a concern then you'll likely find some unregulated forums related to sites of that sort.
Heck if we can get away from those pesky grammar police dept that hijack thread be a plus for me and many others.
