Does anyone know anything about a law suit between Pulte Homes and the Wolf Creek Condo Association?? I've was told today that you can not get a loan to buy a condo there because of the pending litigation. Does anyone know what Pulte is being sued for?? I thought they were a reputable builder.

The Wolf Creek Condominium Association had an engineering firm inspect the property during turnover. The Association asked Pulte to remediate issues found by the engineering firm. They refused and therefore it was the Board of Director's fiduciary duty to do what was right for the condominium owners, so the Association sued Pulte. It is interesting that the mortgage companies will loan money to buy a condo from an association that has very little in reserves, has trouble with collecting enough fees to manage the property, has known and unknown problems that could likely lead to special assessments, etc. because the association did not do their do dillegence and sue the developer for not giving them the quality they paid for. At least Wolf Creek has never special assessed their owners, has fully funded reserves, has cash to pay its bills and a developer that is still in business so they can be sued.

I own a condo in Wolf Creek and just refinanced with no problem at all
