Hello,
We are searching for a home in St John’s and are wondering if there are any communities whose HOA’s keep sex offenders from moving in. For example - South Hampton seems nice but there is a registered sex offender there. JCP seems to have a few. Does Cimarrone?

An HOA can deny a felon/sex offender from purchasing a home in the community however more likely the person in question was already living there and cannot be removed as a property owner.

Yeah, that would open up the HOA to a serious civil rights lawsuit. No one checked our backgrounds when we bought our home and I suspect the cost to do so with each and every homeowner in these neighborhoods would be exorbitant.

I think the more expensive the houses are in the community the less likely a sex offender will move in. So according the info below you will have to check with the HOA.

"On the other hand, Florida allows associations to implement restrictions. "In Florida, unless there's a provision in the association's governing documents that deals with whether people who've been convicted of crimes can live there, the association has no power to keep those people out, whether it's a murderer who's been paroled or a sexual predator who's served his or her time," says Robert L. Tankel, principal at Robert L. Tankel P.A. in Dunedin, Fla. "To keep them out of the association, it has to be voted on by the members and in the governing documents. I strongly urge that associations consider a document amendment to deal with the issue.

"If it's not in your governing documents," adds Tankel, "work with legal counsel and local law enforcement to determine the best route of notification, if any. There's no standard protocol for what to do about sexual predators or offenders within a community association. It's not defamation to tell people that someone is a convicted criminal, but it may be beyond the association's jurisdiction.""

I am sorry to find this post and almost laugh, but all of you realize that the reality is they live everywhere, right? I mean all the offenders list does is tell you WHO HAS BEEN CAUGHT! Many predators go decades without getting caught and it's the same as a background check - it is only helpful if the person has a record! My husband was a cop and I can tell you, if you are looking for a guarantee, you're lying to yourself. These days, predators live right under our noses and while we do not want to accept this, the sooner we realize there are no perfect places, the faster we can help our children with honest conversation and teach them how to be prepared God forbid....it is a sick world and as much as my reply here may make you mad, fact is you likely know it is the truth.

As far as places that have no one living there that is on "the list" there are many "safe" neighborhoods, but it doesn't mean there really are none. But no, HOAs do not run background checks on buyers as far as I know - I have never had one client had to submit to a background check. They may be checking names at some point, but I am almost certain that the HOA doesn't even get the buyer info until after the closing, so again, don't count on others to protect your family from harm.

It's free to check the sexual predator registry. You can actually search by neighborhood, it's that easy. It would take them a minute to check.
