I was asked a similar question once by a renowned head hunting firm. What I should have said was, "I'd be pleased to answer your question if you can explain to me how it's related to performing the responsibilities of the position."

But I like I'm Retired Now's answer better.

Well, sure, but there is nothing illegal about asking someone's age at all.

It's illegal to discriminate on the basis of age. It is NOT illegal not to ask someone their age.

it's not illegal to ask. Most of us in the working world know this.Now if they choose to discriminate, you can't prove it as a candidate. All they have to do is say something cryptic like "we found someone who was a better fit." Or "it's out of our budget range so we won't be hiring right now." In the meantime they asked every single candidate the "high school graduation date" question. They chose the 24 year old and rejected everyone over 40. You have no way of knowing or proving that's what actually occurred. Only the company knows. SO WHY EVEN BOTHER ASKING THIS QUESTION THAT CLEARLY POINTS TO AGE.

The reason they ask questions that reveal age is because they will probably discriminate.What other reason is there for asking that? Of course if they have a website or other social media page, you can quickly see if anybody over 30 or even 40 is working there. If not then you know why they're asking age related questions.

Age discrimination could not be proven unless they produce evidence of it in writing or you record them telling you, ''We are looking for someone younger.''
But they do it all the time, more and more, by asking your birth date, year you graduated, ''are you under 40?'', etc.
They want to screen you out before you darken their doorway for an interview.
