2 questions im not sure how to answer or if i should be honest.
I have passed the interview portion and now they are doing a through background check. Fingerprints, drug test physical, diploma etc. Its a job for a state law enforcement. I wont say where or for what.
The situatation before the question.
I recently worked for the State, got jumped in the bathroom by a guy because his GF was calling me asking me to do stuff to her. I never did but regardless it wound up in a fist fight, i was placed on administrative leave and eventually they decided to dismiss me. I negotiated with them and they let me resign in good standing, however in the agreement letter it says something to the effect, they may release details if any STATE agency contacts them about my employment history.
Question 1
Have you ever been discharged, asked to resign, furloughed, or put on inactive status for cause, or subjected to disciplinary action while in any position?
Question 2
Have you ever resigned after being informed your employer intended to discharge you for any reason?
I think you have to be honest. Those questions are pretty specific and per your agreement, the place that asked you to resign will disclose this information to your prospective new employer.
You are getting a background check done. Your previous employer has told you that they will disclose it. State law enforcement is very likely to be more thorough about their background check than a place with a sales clerk job.
Better that it come from you.
Is there a place for an answer and not just yes/no? If the version you put here on C/D is the same as the version that the ex-employer is going to give, just put down that you were physically attacked and that your ex-employer decided to ask both of you to resign.
Either way, you might not get the job, but if you are caught in a major lie, it will be "no" for sure. If you are honest at least you have a chance. Being willing to get down and battle isn't a total negative for a law enforcement officer, as long as you didn't provoke it. A lot is going to depend upon what the ex-employer's version of events sounds like.
The answer you are looking for is "yes" to both questions. Why do you expect them to put you in a position of trust if you can't honestly answer a simple question? Expect them to view you personnel file as part of your BI. Disclosure of your issue may get you disqualified. Failure to disclose your issue will get you disqualified. How long ago did this happen? They will also want to know how you "wound up" in a fist fight at work.
Most likely you having gone through the situation isn't going to be an issue. But lying about it certainly will be.
