I have to know this - in regards to my thread below ..... Usually when you're looking for a job a prospective employer or agency will not contact your current job because they know you don't want your boss to know you're looking because the boss may get mad, co-workers might start treating you different, etc.
But what about AFTER you're hired?? Will the new employer contact your last job then? Even after they checked your references already from your previous jobs, did their background/criminal check & all the other "checks" they do??
Thanks guys
Any other info you can share about employment laws etc would be appreciated because I'm trying to find out what I can and cannot do about this firm FIRING ME AFTER ONLY 8 DAYS
There is almost certainly nothing you can do unless you are claiming you were fired for being a whistle blower, etc. Employers have great leeway in terminating employees, especially during what would be considered a training or probationary period. And, regardless of what the misinformed on CD like to spout off about, a previous employer is allowed to tell a perspective employer that you were fired, as well as why you were fired. What they are not allowed to do is lie about it or provide false information. As a matter of course, a lot of employers don't do anything but confirm dates of employment. I wouldn't list an eight day job on an appliction or resume.
So what would happen if they contact them after the applicant was hired and the former employer gave a terrible reference?
The employer could make whatever decision they wanted to, as long as it is legal. An ex post facto investigation after someone is hired would be extremely unusual and is more likely the result of new information coming to light, rather than by a failure to do a background check to begin with.
Thanks guys

If you really want employment law talk to a lawyer, not an internet forum. Good luck on your search!
