I need some help, we reacently moved out from an apt to our first house.
We stayed in the apt complex for 1 year and we dint have any problem there. we gave enough notice before moving out and I cleaned the apartment myself before handing over the keys.
Now they are charging us $900 for a carpet stain due to which they say they had to change the whole carpet.
I agree there was a stain but I am sure it could have been removed by prof cleaners. And if they had to replace it they should have informed us about the charge.
I dont know if there are any laws but everyone is saying that we have to pay off the money else they will put it on our credit.
There was no walk through while leaving.
n the leasing office is saying these are indisputable charges.

Any advice or suggestion is appreciated.

First thing what does your lease say about stains/damages, etc. Most of the time carpet is one of those things that is considered wear and tear, which usually isn't charged to the tenant. Now if they just replace the carpet before you moved in, and the stain really did make them replace it, they may have a point.

I would request to see the carpet to make sure they actually replaced it.

Otherwise, contact an attorney if it's that big of a deal. I wouldn't take legal advice off a public forum.

Default In Kansas, The Renter has all the rights

I lived in Kansas for two years, and got to be really good friends with my apartment leasing people (made a lot of small-talk with them).

They said that in the state of Kansas, the renter "has all of the rights", meaning that they have a lot of legal power. There was a tenant who was supposed to move out by the 31st for a new renter, and they hadn't, and all they could do is "remind them" to leave...there was a ton of legal paperwork and issues in order to evict them/force them to leave. In other states, the landlord could have changed the locks and thrown away all of their belongings.

Listen to the previous poster. Contact a lawyer. Kansas (from what I know) has strong laws about being a renter. Make sure to have your papers signed when leasing handy.

See if you have access to Legal Aid. You can Google Renter's Rights in KS, also Landlord's responsibilites.
Some apartments replace carpeting between renters.
