I'm sorry to hear about your cancelled plans, but the law is a good law. AG land is just that (for agriculture), and many people have built buidlings that were never intended to be there in the first place.

For example, on AG land, many people have built huge homes (on Kauai) that they rent out short term, and say they are growing "lawn grass" to fit in the AG category. AG land is considerably cheaper than non AG land. The AG land is for the purpose to grow produce and create sustainability for the island. It is just plain wrong. That is my opinion.

There are so many other wonderful places for you to stay at. I promise. Plus, when on Kauai you should only be sleeping in your room. There is too much to do and see.

The deputy Kauai county attorney wrote a legal brief about the issue in 2000 in which he states vacation rentals outside the visitor zones are not illegal according to current zoning laws:

I think more recently the county changed it's mind and didn't want them anymore but were handcuffed by the old zoning law.

My point is don't burn these people at the stake for running "illegal" operations. It's not so black and white.

I do agree with the previous poster about how Ag land is totally abused which is very sad. They should be more focused on self sustainability.

Illegal B&Bs are problematic for the everyday resident in many ways.

If the OP is so highly offended at what the local (ie Kauai) politics and laws are, that they don't want to come visit Hawaii anymore, well that sounds fine to me. I have a particular distaste for tourists who want things done to please THEM, and think "to heck with what is best for the everyday resident who lives here".

Correct me if I'm wrong but from my understanding, all beaches are federal property from the mean high tide line and are only managed by local authorities.

In the United States - the federal government has a territorial sea that extends from the high tide line to 12 nautical miles. Hawaii has coastal jurisdiction for 3 nautical miles. Texas, Florida, and Puerto Rico get 9 nautical miles. Beaches in the US are managed by a combination of state legislation, public trust doctrine, and the coastal zone management act.
