I do find it ironic that it's Capitalism that stopped this man from selling anti-Obama stuff in the mall when President Obama is clearly anti-capitalist.

The right to free speech is trumped by the rights of property owners. As dumb as they may be for asking a paying tenant to vacate immediately, the Johnson City Mall owners have every right to do so. The free speech of the vendor stops when he ticks off his landlords. (Then again, it probably would've been nice on the mall's part to specify in their leasing contracts that they won't tolerate anti-Obama merchandise.)

While I think President Obama is despicable, I have to side with the mall owners. It's their property. They can be as stupid as they want with their own property. If they'd rather lose income from a trusted vendor because they disagree with his politics, they have ever right to do so.

But one thing's for sure; I'll buy an anti-Obama bumper sticker from this guy long before I'll ever step foot in the Johnson City Mall.

The right to free speech doesn't mean that anyone can say anything anywhere. If someone comes onto my property, I don't have to put up with his/her "free speech" and can make that person leave.

We have moderators in this forum for the same reason. Those who own this forum have decided what kind of speech is acceptable and what isn't. Our "free speech" is limited; we can choose to accept it or we don't have to be here.

The Johnson City Mall owners get to decide what is acceptable speech and what isn't acceptable speech on their own property. I may disagree with it, buut that's too bad for me.

I support the right of the private property owners to decide who they will lease to.

The consumers have the right to choose where they spend their money.

If I gather up about 3-4 rabid christians (shouldn't be hard to find around here ;-) and have them complain about Spencer Goods do you think the mall would toss them out? That store is the new Radio Shack of the mall world...no idea how they stay in business unless there still living off the proceeds of all those black light poster sales from the 1970's
I heard that the owner of Concord Mills is a big Obama supporter. Wonder who owns the mall in TN.

I could be wrong on this but it looks like it is owned by a real estate trust company. This usually means that there are many owners who invest in it and not one person, but a corporation entity actually owns the properties involved. However the founder and current GRT and Chairman of the board is Herbert Gilmcher

For one small kiosk in a small mall in a small city, they probably don't care. Even if they get sued and the attorneys feel like they don't have a case Glimcher will probably just pay Fuchs off and tell him to go away.

That would probably be more $$$ than he could make off a few t-shirts and bumper stickers anyway. Who knows, this is probably the best thing that ever happened to the owner of that kiosk.
