My 84 year old mother signed a 6 month contract to sell her manufactured home and land in Las Vegas, Nevada with Century 21. I've since had to put her in assisted living and her mind is going from dementia. The contracts going into month 5 and this agent has only shown the property twice and rarely return messages.

Can this contract be broken by her son's due to the mothers condition. I'm one son and I'm on file with C21 as power of attorney. I'm going broke paying for my mothers care and this agent has been selling these same homes in the neighborhood for 20 years so she can well afford to sit back and wait out the market. We realize the markets bad but I need a younger thinking company that thinks outside the box before I go broke.

There is probably a performance clause in the contract. The contract will have the details that indicate how you can terminate it and for what reasons. If the agent hasn't been very active, he/she will probably agree to end the contract if you call them and explain you aren't happy with them.

I've fired a few realtors and don't recall any contracts saying I couldn't.

Also a letter to the Real Estate Commissioner describing the realtor's behavior will get her attention.

Ask the agent. Then ask the broker. I would be very surprised if they did not let you go after perhaps offering another agent. In fact on most manufactured homes they may not be able to get another agent to take it.

Note that if it is the normal Desert Inn Mobile or such 6 months is par for the course and you are not going to find agents jumping at the listing.

If they won't agree wait it out. Too much trouble to break it without agreement.

Thanks for your replies. I have advertised it myself but only get calls from agents wanting to list it. When I check out their websites I find they already have 80 homes listed in our same zip code. I'll try to hang it there a little while longer.

Just tell your realtor you want out because you feel she isn't doing a good job. That's all it usually takes. Real estate tends to be a word of mouth business. Usually they would prefer to back out if you are unhappy rather than have you go tell 100 people how they did a bad job.

Consult with an Attorney of Elder Law. If she is going to have to qualify for medicaid you have to be very careful when selling property.

Nah.. You have to be very careful if you are going to try and keep the money and then use medicaid. If you are simply cashing her out and spending the results on assisted living it is no problem.
