If I had taken the rebate but missed my grass (in time), I would have replanted it without even considering the water authority. What recourse would they have? I imagine the likely recourse would be to recover the rebate, plus interest plus administrative fees....which is exactly what they are asking for in this case.

The mentioned person replanting grass is doing it at a financial loss, now a much greater loss since they have now paid for the following things:

• Original yard
• Rip out original yard and install Xeriscape yard minus 1.50 per square foot grass rebate
• Rip out Xeriscape yard and install grass yard plus 1.50 per square foot reimbursement, plus interest, plus administrative fees.

This is an indecisive person that loves their grass.

I don't see this decision as one that encourages people to start planting grass like crazy, they aren't paying you money to install grass like they still do with Xeriscape. I see this as agreement that telling someone they have to maintain their yard as Xeriscape "in perpetuity" for a lousy $1.50 was overstating their bounds.

Perhaps the contract should have read that they must maintain it in Xeriscape for 3 or 5 years instead? Since it doesn't, I support forcing the person to repay the rebate, plus interest and administrative fees as punishment for deciding to replant real grass at a later point in their property ownership.

I tried planting grass in my backyard when we moved here(aliante) and the grass would not grow. The soil is like cement. I then found out that we cannot plant anything without permission anyway, so it's probably good that the grass died on it's own.

Economics. When people replace lawn with concrete, the revenue to the water district drops, dramatically. Add to that the recycling of water by major casinos and vacant homes due to foreclosures and they are suffering. Adding all that water revenue back in plus the repayment of the credit will be a great cash cow.

I don't have a problem with grass, as long as it's properly regulated and for medicinal purposes I don't see the problem with it.

Just accepting what they can't fix. There never was any way to prevent replanting grass. They have merely set up a mechanism to get their money back if you do.

They could take you to court to recover I suspect. But they would not have been able to force the ban...just to get their funds back.
