Seriously though, you are helping people who often do not have the means to pay a consultant and are desperate. If you were giving free advice an oil company, I'd say soak 'em.

For those facing an unemployment hearing I cannot stress enough - GET A LAWYER! I sought legal advice for what I thought was an unfair termination. My attorney agreed that is was an open and shut case and that I did nothing wrong. Thinking I was prepared and not wanting to pay the $250 to the attorney I went to the hearing. As prepared as I thought I was I felt outnumbered and outgunned when the nasty corporation (Lenscrafters) rolled out their pitbull attorney and trotted out "coached" witnesses who perjured and contradicted themselves left and right. The unemployment hearing officer "Annapali", was a low wage idiot, who succumbed to the forceful presence of the corporate attorney and over-turned my original approval for unemployment. I was so in shock and outraged over the miscarriage of justice I hired an attorney, $750, and filed an appeal. In the state of Nevada, the Board of Review, is deluged with such appeals...wonder why? Save the state some $$$ I think. In any case my appeal lasted all of 5 minutes and one week later the Board of Review ruled against me. As my attorney warned me; 99.9% of the time they just rubber stamp what the $8/hr hearing officer ruled. So don't make the same mistake I did...always, always, ALWAYS - GET A LAWYER! Look for a good one. Do your research and find a specialist. There are a few. Mine was Christian Gabroy - who is good but I wish he pushed harder to take my case in the first place. And write the Attorney General Catherine Masto - let her know - since she is responsible for these Board of Review idiots that you will hold her accountable in the next election. She certainly won't be getting my vote! Or that of 35 of my close friends and family! Fight Back and Fight Hard! Good Luck People!

This post is so full of crap I won't even try to cover all your misinformation. But if you feel a lawyer will help, get one; although it is usually not only unnecessary, it is a complete waste of money that people who just got fired don't usually have. I've never really met a lawyer that knew UI law very well, but maybe there are a few. I'll say this though: I took the test for Appeals Referee and those guys are smarter than I am, and make a whole lot more than $8.00 an hour. And the Attorney General has absolutely nothing to do with ESD. Just like jailbirds though, people who have been fired are always innocent.

Wow.. i totally agree buzz... my wife had to go through this.. no issues, they were nice....

What a nice reply. Just what one might expect from a self-appointed expert who took the Appeals Officer exam. Are you really trying to support those who are facing the unknown or protect those who are working on the other side? Seems you spend a lot of time giving "free" advice. Makes one wonder is it really "free"? Looking at the way you misinterpret responses that go against your views and the language you use in your posts I wouldn't trust you further than I could throw you.

If you care to look, I do believe Buzz worked for the Unemployment Officer for 20+ years. Who's advice would you rather have or do you just like popping in and cutting people down?

A little homework Professor, will often allow people to save face before they open that big hold under thier nose.

For the record, it is another misconception that ESD staff try to prevent people from collecting their unemployment benefits. They actually try to help people get whatever benefits they have coming to them. It is actually to their advantage to have lots of happy clients, so it really is the other way around. One thing they cannot do is break the law for you, and they are trained on a regular basis to follow procedures; but it has nothing to do with preventing anyone from being eligible for UI. But I personally have gone way above and beyond the call of duty to help people with their UI, and have seen most of my fellow workers do the same, only to get nothing but grief from the claimant we tried to help. But, most Claims Examiners continue to try and help even when the person gets upset. The risk a Claims Examiner takes when he or she goes out of their way for someone is that the person will still end up turning on them. Every good Claims Examiner has had needless complaints filed against them that were complete and total falsehoods made up by the complainer just to spread their own pain around. It seems that losing a job emotionally hits people almost as hard as a death in the family, and people out of work look for someone to blame; so, as crazy as it is, they blame UI Claims Examiners. But that's the person you want to be nicest too in my opinion. I have read that one of the various traits of insanity is to attack the wrong target. Get a flat tire, kick the cat. Lose your job, attack the one person that can possibly help you, and that had nothing to do with you losing your job. It's never fun to be the messenger of bad news, but it is amazing how many people in this world always kill the messenger.

Thank you gulfer. I guess I should stay out of it, but the bad advice that I read on here just bothers me too much to keep my trap shut. I have said 100 times that in all the years I worked at ESD, every single day I would have people tell me that a friend or relative told them this or that about filing their claims, and not once was the information they were given accurate. Not once.

I recommend that people do not even mention it to anyone outside of the Employment Services Division or Nevada's JobConnect because the chances are too good that the information they get on the outside will cause them to lose some or all of their benefits.

I handled upper level UI appeals in AZ for many years. I made more than 8.00 an hour, believe me. It's true that very few attorneys who represent claimants, even "employment lawyers", know UI law very well. In AZ, in my experience, very rarely were claimants represented by lawyers, and many of those were still successful either defending a favorable deputy determination or reversing an unfavorable one. If AZ and NV are similar in terms of the process, what is important, at the first appeal level, is to read the rules and present all the evidence you have, as you will likely not be able to present additional evidence if you proceed beyond the first appeal hearing. That's why hiring an attorney at a later stage of the proceedings makes even less sense than hiring one earlier in the process.
