Bottom line, if you know you're going to be drug tested then don't do drugs. If you have an alcohol test scheduled don't get **** faced the night before.

In some occupations (trucking, railroad) a drug/alcohol test is mandated by law after an accident. In the case of railroads that includes not only the train crew but also office staff directly involved with the train movement. The tests will be performed post-mortem if necessary.

Right. I don't understand the sense of entitlement that some people that do drugs have.

If you do drugs you just have to face the fact that you are UNSUITED for some jobs.

Find a career where your habits don't conflict with potential employer's requirements.

BTW drug testing does not violate your rights. An employer has the right to set minimum standards into their job descriptions.

The right that you retain is to refuse to give the sample and GO HOME with your rights intact.

I don't understand the sense of entitlement that some employers have to demand control of their employees lives while off the clock.

There are thousands of different things an employer could legally demand employees do or don't do while off the clock. No peanuts, you might touch someone with a peanut allergy at work and send them into anaphylactic shock. No really loud music, you might damage your hearing and cause an accident because you couldn't hear a warning signal. No over-eating, you might get so fat you break a chair and injure yourself or someone near you. No traveling to third world countries, you might contract a disease and then infect everyone at the office. No gambling, you might get into debt and become a liability to the security at work. These sorts of restrictions are just as ridiculous, but they aren't a taboo so hardly anyone is willing to rationalize them.

The fact is that the number of jobs for which drug testing is mandatory is orders of magnitude larger than the actual number of jobs where drug testing is suitable. And even then daily impairment testing would be much more effective at reducing risk than after-accident drug testing - a practice that is not about preventing accidents, it is only about shielding employers from liability. If the employee was intoxicated, that puts the liability on him, if he was not impaired, that puts the liability on the employer for creating a dangerous work environment.

We also retain the right to point out that the vast majority of drug testing in the workplace is absolutely unjustified by anything other than the employer's personal taboos.

My last employer, before I became an independent contractor, did exactly that. They even had manufacturing facilities on-site (instead of contracting out to Hong Kong) and they didn't test the people on the floor either. Respect for employees was an enormous part of their corporate-culture, it is part of the reason I can see that drug-testing is so absolutely disrespectful of our basic dignities.

Hewlett Packard bought them for about $150M and grand-fathered the no-drug tests clause into the employment contracts of everyone who came over to HP with the buyout.

Some employees may get away with it but if caught, consequence could be a suspension or even termination. It would not affect the business at all. My last employer did not drug test at all. I did not want to start using drugs because of that.

That is not necessarily true. I got caught drinking on the job a little over 10 years ago, and I was a delivery driver, but driving my own vehicle. A receptionist turned me in as she smelled it on my breath and called my employer, and I got caught when I came back to the office. I was told if I ever did it again I would be fired, but I kept my job and never got caught again. About a year in on my last job, my supervisor came to my job site and caught me red handed. I was told basically the same thing in that he would not write me up as he knew I would be fired, but if he caught me again he would. I decided at that time the risk was not worth it, and I never drank at work again after that.

My co-worker was just terminated recently because of drug use. She refused drug testing the same day she got caught with possesion of drugs. It fell out of her pocket. She was terminated the same day and unfortunately for her and her 2 kids, she may feel it is her "right" to do illegal drugs.
