Here is my whole story of termination, no lies, straight up what happened. I want to know if I am eligible for unemployment



I was employed at a Casino in NV as the acting Supervisor of Security. A fellow Assistant Supervisor was dozing off behind me about 15 minutes before our shift ended. This entire ordeal was caught on tape, yet in the 15 minutes I was conducting work WITH MY BACK TURNED to him, I might have glanced at him once or twice and the two times I did, his eyes were open.


I was called in and told I am being suspended and then fired for a "bad call of judgment" because I did not attempt to wake him up, send him home, etc etc.
During this suspension, I was never asked for a written statement or my side of the story, I was basically told what I did and did not do and then told to leave.

I was however asked why he was not written up by me for this occurrence, the irony is, I typed up a write up the day after it happened just for him "dozing" not sleeping. I could not issue the write up because he was off for 2 days and then I was off for 2 days and we were both suspended a day before the write up was going to be issued.



I feel I am being terminated for another persons mistake. The video clearly shows me working on a computer, with my back turned, as he is slumped in the chair. The few times I get up and move around, he changes his position in the chair.

File for unemployment. If the casino denies it, then you go before a mediator. That is to whom you tell your story.

If this will effect other employment then get an Attorney and fight it. At least get an opinion.

Anytime you are unemployed for any reason you can file for unemployment. The only people who can tell you if you will be eligible are the people at the Employment Security Division, but only AFTER you file a claim. If they find there was no misconduct on your part, and if you are otherwise eligible, you should be able to collect Unemployment Insurance (UI). If what happened is determined to be misconduct by an adjudicator, and/or a appeals referee, you will be given the decision in writing and it will tell you what you have to do to meet eligibility requirements in the future.

A couple of questions though. How long did you work there? How long ago did it happen? And why did you leave the employer just before this one?

I was employed for 2 1/2 years with no prior discrepancies or write ups. It happened about a week ago and my previous employer I voluntarily quit with 2 weeks notice due to being offered a better paying job.

File a claim. Most people don't know that the burden of proof is actually on the EMPLOYER. They have to prove that you were negligent. Even with video they will probably lose.

File the claim next week if you are able to work, available to take a job if offered one, and looking for a job at least three times/days a week. You could have filed right away as long as you were looking for another job. If eligible, you collect UI from the week you file, so there is no back pay just because you were fired two or three weeks ago. Unless you received severance pay and/or unused vacation pay, there is no reason to wait to file a claim. You're just losing money if you do. And it is an insurance claim ...Unemployment Insurance (UI). The insurance is paid by your previous employer(s).

The previous job that you quit, if it was 2½ years ago, doesn't count against you. If you had quit a job in the last 16 weks, even if you had quit a second P/T job while working F/T for this last one, less than 16 weeks ago, it would count against you.

Anyway, file by phone ASAP: 486-0350. Nevada Department of Employment, Training and Rehabilitation
