I would guess those lawsuits would need to be brought at the state level. What are the chances that someone in the state legislature sometime in the past snuck some language into a bill somewhere that protects the casinos from such claims.

I have said this so much I am blue in the face. Smoking is allowed inside because of gambling. No one wants to make a video poker player stop playing to go outside to smoke. Hiweve, anyone who is not gambling can still smoke indoors. The real problem is with smaller local places that have video poker but also other things like pools, darts, etc. and who cannot afford new air filtration systems. These places are full of smokers who are not gambling. Kind of pisses the rest of us off who were hoping for a little respite from smoke. Employees are expected to suck it up or leave....which is not right. These employees also have little or no health benefits. So many of my friends work in bars and have been there for years and hate the smoke, but what can they do? People who smoke inside are already too moronic to voluntarily be considerate and smoke outside. Let gamblers smoke if that is why the law is in place, but as with drinks they should buy their smokes from the bar and not bring them in. I would love to bring my own wine in when I play pool. See, there is no logic here.
