I wouldn't go so far as to say that their opinions don't matter. They are still residents of the development, so any concerns that they have would be heard. As far as voting goes, very few issues go to a vote of the homeowners. One is election on board members. Another would be any changes to the CC&Rs, which very seldom happens. In six years on my board, the only thing that I have seen come to a homeowner vote is board member elections.

Which brings up a question, If a rule or policy changes and the renter can't comply but signed a long term lease before the rule changed, what does he do? He didn't have a vote. Oh right, who cares?

Virtually never happens but if it did there are generic clauses that likely apply. The Land Lord for instance has to supply a habitable unit. So does the change impact that?

And anyone with some specific need, say to run a business from the home, should have a specific clause allowing it.

And finally if in some weird case it did happen the Landlord and the tenant make a deal. Virtually always a better outcome than a legal fight over it.

It's the renter's responsibility to comply with the rules of the HOA. I doubt there is anything in their lease that would alleviate them of this responsibility.

Sun City Summerlin had segments built as late as 1998/9.

Sun City Anthem is also public right of way built into the 2000s. Sun City Aliante has public right of way and was built as late as 2005/6.

All the exceptions are gated. There are neighborhoods built in the 201x in the NW which have public right of way. There are also cul-de-sacs in the NW which have private roads. My cul-de-sac for instance is owned by the property owners. Interesting though. Had a large argument with the Police on an occasion when they insisted the road was public. Called the NW Center and they got straightened out. The argument for owning by the way is you can restrict parking which is sometimes desirable.

We have the opposite problem in SW. Very few public roads down here in a land full of HOA run streets and we have serious issues getting the county to deal parking issues - mainly, abandoned/dumped stolen cars.

It's taken up to 1.5 years and multiple complaints from multiple residents to get them to dispatch a tow truck.

Lately, they've also decided they don't need to maintain street lights down here. After complaints from 3 residents about a particular light, they came and changed it, but left all of the others that are burned out on the street untouched. Around the block there are a couple of strings with burned out timers that have been on 24/7 for a few months now. Tax dollars at work.

Where is that? I know NC is kinda like that, but not most subdivisions in the US.
