Yes, people can live in a property that is in SS. There are a lot out there right now occupied in short sale. Their logic is faulty. My opinion, the LL stiffed the bank and now she's attempting to keep me from remaining in the house after the auction provided it takes place on the 26th.

To be honest, I still have the option available. The mortgage guy I'm working with is aware that I want to go to Colorado, but it would be hard to get a mortgage without employment, so it would be delayed. Good news, he's licensed there so the loan would be good in Colorado.

Did I happen to mention that I live on a teeter-totter? LOL

LL has no further say if it goes to auction. Not even sure why he would care. If the auction goes down you get at least another 30 days. And maybe key money. And you may even get to stay depending on who it is foreclosing.

On second thought, not going to send the letter. Going to sit quietly and be patient.

It will cost me $33, but I will then file a stay and a motion to dismiss based on the lease contract terms (30-day termination notice by certified mail) and attach the lease to the motion demanding proof of service.

I believe the lease contract terms and the fact they did not follow their own contract should be enough to vacate the order, and I'll ask with prejudice.

Isn't legal strategy fun?!

Yeah, I thought I got off that roller coaster when I divorced. But, then I spent 5 years in litigation with AH. But, that's another story.

Quick update,

Good news!

My bank finally gave me a loan mod. I'm now paying half of what my mortgage was originally at. This is one of the best news I've had all year.
