Hi, I have a question.

I have dual citizenship. (I.E 2 passports) Canada and France.

I have a criminal record in Canada, thus can't visit the US without a waiver.

Can i use my french passport and enter with that?

Depends on the crime; using the French passport, you will be travelling on the Visa Waiver program. If it was just a missdemeanor, you might be ok, but if something more serious, you will likely need a B2 (tourist) visa.

yes I have got though the questions on the ESTA and everything would be OK on the form, DUI isn't a crime of moral turpitude and I've never been rejected at the borders.

My only fear is if they can link my french passport to my canadian and download my criminal record in their database, Which it isn't in at the moment.

This is a personal answer only - as DUI is not a criminal offense in the US (depending on the individual case) why not go the waiver route if you are sure there is nothing else in the closet? This would give you total peace of mind. Especially if there are future plans in the works.

I was hoping to avoid getting my record downloaded in the US database and just get a Canadian pardon in a couple years and never have to worry about it ever again.

I've heard stories of people getting turned around because of a dui.
