first off, i know i need to seek professional legal advice, but wondered if anyone had any idea on the following:

i am a UK citizen living and working in the US for an employer, and currently hold a valid L1 visa. my wife and eldest child are valid L2 visa holders, and my youngest child is a US citizen (she was born here).

im considering handing in my notice at my current place of employment, to take a position back in the UK with a different employer. i have a contractual obligation to give 3 month's notice. there will be a lot of sorting out to do in the US, not least of which, the sale of our US property, and im not sure how long this will take.

so my question is this: as the holder of a employer-based visa (L1), from the time i hand in my letter of resignation, with the subsequent obligatory 3 month's notice period, how quickly do i need to have left the US? is it more or less immediately upon the completion of my notice period, or is there some sort of period of "grace" for employer-sponsored visa holders?

we currently also have green card applications in, which have been listed as "under initial review" when we do the online case status check, which went in last september.

many thanks in advance.

It's usually 30 days grace period, but do double check that some place official.

Your green card apps will likely be considered abandoned if you leave the country.

If you abandon the GC process, please leave USCIS know so they cancel the whole thing and do not waste visa numbers in your case if you will not be here.

you need to leave immediately as soon as your last day at work. unless you plan to join the employer back once GC is approved, which does not seem to be the case so. As you are accepting full employment abroad

There is NO grace period. Alternatively you can move to the Visa Waiver Program which will allow you to stay for 90 days. Check with the attorney if this is possible and what the process is, it should be. Else you may end up being Out of Status

Your GC will be considered abandoned from your last day at work with your sponsor employer. Unless of course you and your sponsor agree that you will join them after GC approval [I would recommend you maintain documentation in such a scenario].
