My friend is still married to u.s.citizen but her husband cheat on her, now my friend is.here.tru j1.visa.internship

I told her.to.get a.lawyer.to win her case..
The husband is citizen and my friend is married to him
She should have a visa too eventhou they guy is unfaithful and my friend is not living with him anymote

My question is,, my friend is married to her citizen husband but she needs to go home to Philippines To finish her college.. when she found out that the guy is living with someone else now here in us..while they still on marriage,, my friend doesn't Want to reconcile with him anymore.
On the other hand my friend is back here in us after college
With j1 visa...is there anyway she can get a waiver or something since they still married and not yet divorce.. beside shes married to citizen..and whats her option

I don't think she has much of an option either where her J1 visa is concerned or through her marriage to a US citizen with whom she's no longer living. Presumably she never started the steps towards becoming a permanent resident alien when she married and now that that marriage has apparently broken down so much that her husband is already living with someone else, that option is pretty much gone.

I'm sure she knows the restrictions placed on her J1 visa but she'll find out a lot of information by going to the USCIS website which is linked in the first "sticky" on this page. Once her J1 visa has expired, it seems she'll have to return to her home country.
