I think your best bet is to let THEM figure it out. If your MIL lied to you about this, it's very possible she may rely on you in the future for eligibility on being in the US, and that's the last thing you need, especially with this guy.

I guess you've never been married to someone whose MIL tries to make her daughter or son take responsibility for the scrub in the family (in this case the BIL).
Since OP is the one here asking the questions, instead of the BIL or MIL doing everything they can do to find out if he can attend, it could seem to the MIL that the OP is willing to help their family deal with these kinds of issues.
My future brother-in-law was convicted of a crime involving moral turpitude. He is not a U.S. citizen, but my fiancee is. Her father is a U.S. citizen as well. They both share the same mother who is not a U.S. citizen. While serving his time in prison he was deported to Europe. We are preparing for our wedding and are not clear whether or not her brother can attend the wedding.
Would the first step be to fill out a Waiver of Ineligibility? Is that even applicable to his situation?
Give it your best shot by spending a little money on an immigration lawyer. It's the only way you'll know you tried your best.
I missed both my brothers weddings as I was overseas at the time. Needless to say, cameras take photo's and they can be quickly scrolled through to avoid the boring bits. It's like you were really there... but it only took 5 minutes and you didn't even need to get dressed!
