My driveway is two strips of concrete with grass in the center -- I want to replace it with either a solid concrete or brick driveway, with no center strip of grass, and widen it by 12 inches. In the town of Oyster Bay does this require a permit, and what distance from the property line is legal? Can I leave twelve inches of space, can I even widen the driveway up to the property line? my driveway in Queens was full concrete between both houses...
YOu do NOT need a permit to replace a driveway In Oyster Bay. However it must meet the side yard set back of the zone unless it leads to a garage. If your are in an R1-7 zone, it must be 8' from the side yard. If you are in an R1-6 zone you must be 5'. If it leads to a garage it can be closer but no closer than the garage.
You do need a permit to cut the Curb or replace a curb cut.
Thank you for the reply and this critical information -- the driveway does lead to a garage.
