I was on the Northern State Parkway and got a ticket for using a hand held device while operating a motor vehicle. I was on the Northern State Parkway in Commack. Got pulled over by an unmarked trooper in a big suv. Told me I was holding my phone in one hand with my hand on the window. Gave me a ticket of $130 and 3 pts. Fact is I have a bluetooth device and I was dialing.
I have a clean license. My questions is 1) Do I just pay it and walk away. 2) Plead not guilty and hope the cop does not show on the court date 2 x. 3) Higher a lawyer so this way I will still have to pay but not get the points.
Thoughts????

I would pay it. the odds of the cop not showing up twice are slim, and hiring a lawyer will cost you as much as $130 + the price of an insurance increase you'd get from 3pts...though since that isn't a moving violation (per se) i don't think it affects you.
just pay it and stop touching your phone on the Northern State.
Go to court and thank him for pulling you over, and pay what you owe. I am sure you won't agree with me but he did you a great service today. If you had been the cause of a fatal accident you can bet your last dollar that the cell phone would have been checked and you would have been in a real mess and $130 and a few points would look great. Put the phone, black tooth and all, in the rear seat where you can't reach it. If it rings, pull over if you must have a conversation, if not retrieve it when you arrive at your destination and call/text when safe.
You should not be texting or using your cell phone while driving. Couldn't the call wait till you got home? Better yet you should of pulled over onto the shoulder and then made the call. Sorry but you got what you deserved.
I agree with what others have said. Sure, the ticket itself sucks but seriously it is justified - you should never do anything other than driving while you're driving. It really could have disastrous consequences. Pay the ticket and take this valuable lesson to heart.
By the way, I'm glad to see so many sensible responses.
Fight it to keep the points off your license. It can effect your insurance depending on what insurance company you have. And it will be looked at if you try to move your insurance. With that being said, you were wrong, you should not be dialing the phone by hand, if you have blue tooth can't you just dial by number.
