Based on your scenario, yes you would. Based on the fact pattern of what happened 14 months ago, if it was the Police Officer was struck, he'd more than likely be vilified publicly versus the woman who was stuck as she was "legally drunk" at the time of the accident. Now, last time I checked, it's not against the law to be intoxicated and walking...just like operating above the posted speed limit in and of itself isn't reckless as per either the laws of NYS or the practices of the DA's office. Lastly, all of the work put in by the reconstruction specialist is all open to public scrutiny. Personally, I think it's more about what the OP is implying versus saying, but...
Come on, we both drive. We may not know the exact speed we are driving at, but on a public road (passing parked cars) we can guage the difference between 30mph and 60mph. I've been driving for over 30 years and have never gotten a speeding ticket. I've had numerous cars that have gone over the 200k mark (and one that went over the 300k mark). Also being a past NYC Paramedic I took the same driving course as NYPD/NYFD, we were trained to guage speed without looking at the speedometer.

you raise good points NeilVA...but since we don't know they whole story, or more accurately, I know I don't, I'm offering up other suggestions. I've heard stories that he was responding to assist another officer; again...I wasn't there. And, it's just a matter of time before the bashing begins.
And traditionally, the Penal Law supersedes the VTL, and, reckless driving is notoriously difficult to prosecute we well as requiring more evidence then provided here, and, Emergency Vehicles are exempt from the VTL. Is it so hard to accept that it's just an accident?
Emergency vehicles are ONLY emergency vehicles when the emergency lights are flashing, when not they are a regular vehicle subject to the same as any other.

I would suspect he will be a very different driver in any wet weather condition.

Sorry, but no. The point of equipping emergency vehicles with lights and sirens is to allow them to violate traffic laws in order to respond to something quickly. However, police vehicles are specifically exempted under the VTL from having to use lights and sirens when violating traffic laws. Fire trucks and ambulances must use both lights and sirens when violating traffic laws.
many PO think they are above the law...the law doesn't apply to them
