i think it's pretty clear you need to have it out with your neighbor rather than here. You have your legal answer already and you're just getting worked up but nothing will change. If I were you, I'd take the half while it's still on the table.

Absolutely not on your side. Tree hits my house or ends up in my yard I pay for it. End of story. No city data forum discussion needed.

There is no reason to take half as I will be cutting it down myself and placing it back on their property.

ok! Let us know how that goes. Video of events preferred! It'll probably take you hours since you say it's such a big tree. Just skip to the part where he starts chatting with you.

mambwe- I think most people would agree that you are being the selfish one. My feeling is if you could legally do it, you would force them to pay for the entirety of the tree damage/cleanup. You're quick to point fingers when they did nothing to cause the tree falling.

Now that this happened, are you going to go to all your neighbors and offer to split the cost of removing EVERY tree that could possibly fall on your property? You probably won't. You obviously didn't do the right thing if you were worried about this happening with the one that fell on your property.

I don't think I ever said it was a huge tree. Its about ten feet above my garage. I'm not a botanist but its one of those trees whose trunk tapers as it goes up. If it was a huge tree I wouldnt attempt it. I think I can handle it which is why I plan on trying. Doesn't look terribly difficult. Won't be take video, but I might snap a few pictures.

My insurance company says they won't remove the tree and to call them once I remove it so they can assess any damage. She said hers won't remove it either. They have a chain link fence and the top bar was bent from the tree so there isn't that much damage. Unless I am missing something I don't think insurance will do anything. Am I wrong?

Only a selfish neighbor would cut the tree up and then move all of the chopped up wood from their property to their neighbor's property. I bet he can get you summonsed for that if he wanted to since the part of the tree on your property is now yours. Good luck with that.

I wasn't worried about this tree falling on my property. It started to have a little lean after sandy, but came down in the nor'easter. I didn't realize how screwed up the tree was until after it fell.
