You're making things up too soon kayforough. OP does not say that the driver crossed the double yellow line. If she did then she was wrong for crossing the line. Otherwise she did nothing wrong.

Law or not (and I do believe she would've had to cross it at least partially if she hit the guy from behind while he was walking back to the cab), it is unreasonable to expect cars to wait for a garbage truck on a road like that to pick up all the bins before proceeding. The law does need to change to include these situations. If she's prosecuted, it would definitely be on a technicality.

This whole situation sounds like a tragic accident. I live in oyster bay and I know there's a camera right in front of the location of the scene. I would hope the cops did a full investigation before releaseing this person. I couldn't image them letting someone get away with killing a town employee if there wasn't evidence to prove it was just an accident. I too walked by the scene that morning and saw the officers performing some type of driving test on the Mini Cooper, and had the road closed for hours. According to the article in newsday speed and alcohol were not factors. We can make all the assumption we want but unfortunately accidents do happen. My prayers go out to all involved.
