Normally, I am right there with all of you when I tell people "Stop breaking the law, a-hole!", but this is a different situation, hear me out.

My kid brother got stopped and issued a citation for violation of 1160-D: "Required Position and Method of Turning at Intersections". The actual statute states:

(d) When markers, buttons, signs, or other markings are placed within or adjacent to intersections and thereby require and direct that a different course from that specified in this section be traveled by vehicles turning at an intersection, no driver of a vehicle shall turn a vehicle at an intersection other than as directed and required by such markers, buttons, signs, or other markings.
The citation he received states: "Failed to turn as required - no right on red". My brother is a good kid and a good driver and he swore that there was no sign there stating "no turn on red". He said the officer was right behind him, he stopped and made the turn and then got pulled over. Sure enough, I drove by there today and there's no sign. My question is, is there something in that statute I'm missing? The term "other markings" is certainly vague, but the specific "no turn on red" written on the summons leads me to believe that is the violation the officer observed.

So was the summons issued in error? I'm going to tell him to plead Not Guilty regardless.

I agree. Go to the intersection. Take a few pictures with the street signs in the background to confirm where you are, then take further distance pictures to also strengthen the case. Then have your brother plead not guilty. Make sure the pictures have dates on them and have the pictures printed out as well as saved to a camera or phone. You'd probably need both for proof. There is a good chance that if your brother disputes the ticket, that the officer would be a no-show anyway.

I've had the same violation issued. It was confusing to me as well because at my light there was no sign for "no turn on red" either. I called to discuss the ticket and it turns out that I didn't come to a complete stop when I got to the light. I must of slowed down almost to a complete stop and slowly made a right while looking both ways. I was told that I have to come to a complete stop, count to 2 and then make the right. You'll get banged on tickets for just about anything these days.

Your brothers only mistake was that he didn't look in the mirror to see who was behind him.
