I live in the town of hempstead you are allowed 144sq ft of shed.
I just purchased a 12x16 shed which will be over town code.I wasnt going to file any permits i was just going to put it up.What could happen if town finds out
I admit that I don't know the 1st thing about TOH before I say this as I was in TNH. If he did put it up wouldn't someone have to report him and wouldn't they give him a warning before fining? Regardless still in the same boat once it has to go but just wondering if TOH was worse than TNH.
If it's not up yet, no issue. If you put it up and they see it (which eventually they will since they are roaming looking for sheds, pools and fences out of code to raise revenue and keep their jobs). Once it's up the permit fees double ("existing structure"). They will issue a violation. You will have to apply for a permit. It will be rejected. You will have to apply for a variance. It might or might not be rejected. If it passes, you paid extra cash and have a nifty big shed. If it fails (less likely unless it's flat out blocking your neighbors driveway sight line creating a hazard), you're S.O.L.
BTW, read the fine print. It's not just 144sqft. It's 144sqft with no side longer than 12ft so in effect 12x12 is the largest, which is great because who doesn't want a square shed?! Town code gestapo. Gotta love 'em.
I will also add that you decide to put it up find out what the distance from the neighbours side yard is and give it a few inches inside that line. That way the neighbor won't have a leg to stand on as far as software intrusion.

I don't know the setbacks in the town, but I will guess that a structure must be five feet from the property line. Give yourself a little extra space and it is less likely that your neighbors will rat you out. Contrary to the post above, your neighbors will "have a leg to stand on" if they report your shed and it is, indeed, found to be illegal.
I'm not advising anyone to put up an illegal shed, but if you've already bought it and can't return it, then you might as well put it up. You'll be in good company with thousands of other Long Islanders, who have sheds without COs. Attorneys and real estate agents usually look the other way on these items during closings. Just make sure the CO clause in your sales contract excludes sheds. Now, if you don't have a CO for part of the home itself, well, that's another matter that should be dealt with before closing.
interesting, my official survey doesn't even have the dimensions of my shed on it. Just drew the square land it sits on and labeled it shed. I do know it has a CO though.
Thank you for the all for responding.I called today and cancelled the 12x16 which was no problem.I am going to order a 12x12 better to be on the safe side
1st my above post autocorrected to say software intrusion instead of side yard intrusion. That said, ONGISLANDER2, what I was saying was that the neighbors would not have a leg to stand on as far as side yard intrusion, nothing about the size, which clearly is a violation. But it is a moot point now.
