When I bought my present house in July, I reimbursed the owners for the property taxes for that half of the year. Now, they qualify for the middle class tax reimbursement. Do I have any claim to that, considering I paid for about 4 months of those taxes? I do qualify for the middle class STAR rebate.

What gives?

How does that work, then , would you know Tom ? (this would be for next year after I move ). Will they have that check for the middle class rebate every year? Or was that just for this year?

In order to receive the Middle Class Enhanced Star rebate, you have to first be eligible for basic star. You need to apply for basic star and it becomes effective with the new property tax year (whatever date is used by your town). So, say you bought a house in July in Huntington, where the property tax year begins on December 1. You would not start receiving basic star until December 1. That's why NYNewbie is not eligible to get the enhanced middle class star rebate.

From what I understand, the Enhanced Middle Class Star Rebate was a one shot deal for 2007. It will not carry forward unless again voted into law, in which case you will probably need to reapply.

That was great as it pushed my property taxes to below $2600 for Babylon Village . Who was responsible for that anyway ?

They had the enhanced STAR, because they were seniors. In any event, if they file for the rebate, they will get it. Their income, I'm certain, was below the necessary minimum. So, if they file, do I have any claim on that money?

Further backing what you've written I found on the www.nystax.gov website:

[SIZE=2]"You will not receive a notification if:[/SIZE]
  • [SIZE=2]You did not own the property on the date that the basic STAR exemption application was due to your assessor for your locality for the 2007-2008 school year."[/SIZE]

Not a lot of gray area there. Still, what is odd is that the old owners will qualify, and I paid the majority of the taxes.

Actually, you already got the advantage of the previous owners senior enhanced star. At the closing, you reimbursed them for the taxes that they had already paid. Since that was at their rate, you got the benefit of it from the time of closing until the next tax bill due date.

I can't find my application, but I also recall something about 2005 tax year. The rebate was broken into groupings by income something like under 100K, 101K to 175K, 175K to 200K and over 200K. Basically, your income on the 2005 tax return is what dictated what category the homeowner fell into.

But as TomMoser pointed out, you benefitted by reimbursing the previous homeowner at their tax rate, not your higher one.
