I live in a private gated community and not by choice. The Home Owners Association (HOA) has decided to start issuing tickets to homeowners for any vendor that enters the community and rolls a stop sign. For example, if I order a pizza, Chinese, or my pool company enters the development I am receiving a ticket for their actions. I would love to hear your thoughts on this process.

I used to be in property management for a very large HOA complex.
We self-policed many of the by-laws and house rules.
That included speeding, blowing stop signs, parking violations, etc...
Shareholder got the warning letter and/or fines. Responsibility clearly defined in by-laws concerning this and all other matters.

The fines don't go away. They can increase over time from non-payment and the shareholder can be taken to court. They also could be deducted from the proceeds of a sale. First thing to happen usually is a suspension of any ammenities like use of a community pool or clubhouse, etc...
Ive never lived in an HOA development, nor would I ever want to.... I'm having a hard time understanding how an HOA could possibly fine one person for the actions of another.

If it's in the by-laws, they will not win in court. If it's not in the by laws and it's a bunch of idiot board members freelancing, that's a different story.
But what I'm more interested in is how someone ends up living somewhere not by choice.

Yeah, I still dont get that.... How does an HOA enforce a rule that would not be enforceable by any other governing agency? A cop on the highway isnt going to give me the ticket for the speeder ahead of me. Why should I get one because a pizza kid (who i have NO control over) rolled through a stop sign two blocks from my home?
I would hope if it ever went to court that the judge (or jury) would rule this particular by-law as unenforceable.

Many people choose to live in a gated community BECAUSE of the rules.
Protects their safety, privacy, and quality of life.
Some people are morons however, and move in believing the rules do not apply to them.
Others move in and are morons for being misinformed or just ignorant for not reading and educating themselves about the rules.
