Who actually owns the Strip of Grass between the sidewalks and Street? (Hempstead: neighborhoods, living)

If it's like our street the home owners take care of that strip so it doesn't look like #***** to the rest of the neighborhood. When your dog pees on it, depending on the dog, it kills the grass. Some dogs have what I read was a high acid content in their urine? Anyway, the lady down the street is killing that strip of grass and it looks like @#$# now. I've asked her if she could kindly kill the grass in front of her house instead of mine. I've even seen her yank the dog away from a stooping position in front of hers so she could drag it down to mine.

My next step is to put in bricks Who cares if it looks bad at least it isn't dead grass.

I do but you know dogs, they get used to going in a particular spot and won't go anywhere else. Not to mention that is the whole purpose of a "walk". For instance, he only goes pee there but never poops there and will usually only go poop at the corner on another patch but never pees there, etc..

Have you tried putting ground red pepper on the area the dog likes to pee? One sniff and the dog will want to go elsewhere.

Only problem is that it needs to be reapplied frequently.

I used to think that the strip of grass was open for business. But I just checked on the Town of Oyster Bay webiste and found this:

§ 103-5. Nuisances by dogs. [Amended 4-18-2000 by L.L. No. 4-2000]
A.It shall be unlawful for a dog to defecate, urinate, defile and/or commit any nuisance on public property, except that the portion of a public street lying between the curblines may be used to curb a dog, or on private property without the consent of the owner or person in possession of such private property. It shall be presumed that the presence of a dog on private property of a person other than the dog's owner or possessor is without the consent of the owner or person in possession of such private property.


So it sounds like the area between curbs (aka the street) is OK and everything else is off limits...including the grass strip. Oops. I don't even know if my dog would poop on concrete??? The law may be different by Town.

Also, according to that same website, the homeowner owns and is responsible for the land up to the curb. On top of that, if I understand correctly, anything in between the sidewalk and curb besides grass (trees, plants, etc) requires a permit. That last bit of info (if I'm understanding it right) could be used as ammo the next time that lady busts your chops.

This sounds like the feuds between the cattle men and the sheep herders on the Range. One would think that adults could find more to occupy their minds than where their neigbor's dog urinates...but maybe that is all they have to do.

I live in the town of Hempstead, not Oyster Bay. Is there anything for the town of Hempstead?.

I am so glad that I moved to the country! I take back my comments above.....it doesnt apply to me any longer. I wish you all well; living lives that center on controlling your neighbors and their pets. It sounds pretty shallow and empty to me.....but everyone to their own taste said the old maid as she kissed the cow.

looks like the Town of Hempstead has a similar law:

§ 152-9. Nuisances by dogs.
A.It shall be a violation of this section for any person owning, harboring, keeping or in charge of any dog to cause or permit such dog to soil, defile, defecate on or commit any nuisance on any common thoroughfare, sidewalk, passageway, bypath, play area, park or any place where people congregate or walk, or on any public property whatsoever, or on any private property without the permission of the owner of said property.
B.The restriction in this section shall not apply to that portion of street lying between the curblines which may be used to curb such dog only under the following condition: The person who so curbs such dog shall immediately remove all feces deposited by such dog in sanitary manner.
