I purchased a commercial property with an upstairs apartment which had been converted into two seperate rentals. It was a private mortgage and I was unaware it was not legalized. Can it be legalized, and can the tenants remain during the process? Thank you.

Hard to tell. Since it is a commercial property, you might not be able to get apartments legalized. You'll need to talk to the town building department.

The building is listed as a commercial store with one apartment above. Thank you. I will check with the town building dept.
