Well, the law is pretty clear. Sex with an intoxicated woman who is incapable of consenting is rape.

So, the DA wouldn't have dropped this case if they had evidence that she was drunk. Either she was sober and dumb, or she was indeed drunk, but still decided to drop charges because she didn't want these guys to pay for her getting blitzed and not having control over what she was doing.

Most women who are raped while drunk never report it because they think it was their fault for get hammered in the first place.

I think it is assumed because she was at a frat party. I really hope that there are some women out there that agree with me on this. I do not condone any violence against women at all, please don't misinterpret what I am saying. I just think that a woman (young or old) has to own her decisions, bad and otherwise. Ladies, I'm sure that there are plenty of us out there who say "oh God, I wish I hadn't done that!" I don't know any who run to the police because of it. What whe did is wrong no matter how you slice it!

I think she may have been threatened. Who would make this story public then take it back? A stripper OK I might believe it, but a Hofstra student, I can't believe it.

I skimmed through this thread so I don't know if someone brought up the fact that the 5th guy the police was looking for was the guy taping part of the gang bang/train running on his cellphone showing NO kind of struggle or distress. This was from Newsday.com

I am not one to judge someone's sexual proclivity (as long as it doesn't include kids, animals or dead folks) and I'm pretty sure many of us have done something that you've really regretted-but it does not give the person the right to blame innocent people for a poor choice. Yes, if all these facts that came in are true, those boys are INNOCENT. I feel for THEM. I've read posts questioning a person's mind state for participating in a gb on a woman and while the act in the minds of many could seem deviant, disgusting, etc...if the woman in question was consensual (and is sane, not drunk/high, etc...) then there was no rape.

This whole situation angers me because if indeed the woman lied, then her credibility will be shot if God forbid something horrendous like this truly happens to her. Remember the story of The Boy who Cried Wolf? Why would she be believed again? Also, many women (and men) who have been raped fail to admit due to the circus atmosphere that could occur. Often times the victim becomes the criminal when the past is drug up. After this case, who knows how many more people will keep such a horrible thing a secret?

Why? It seems clear that her boyfriend told her to say she was raped. Perhaps she told him she was, but as it was said in the papers her story was full of holes!

I agree, cases like this one are becoming more and more common and we need to draw the line. If you file a false rape report then you WILL be prosecuted and sent to a correctional facility period, the same as if you reported a false shooting or robbery or whatever.

Suspended? She belongs in jail. She's destroyed the lives of those other students. Whether they're exonerated and found to be completely innocent or not, this will follow them for the rest of their lives.
