You are right about more buyers should be asking for such things, I looked at the standard contract and reading through the fine print I do not see anything there that will motivate the sellers to make sure they have the CO's in order before they sell (This is not specific to my case, I'm talking in general)....
There is no yes or no answer to the question "Do you want the house" ?
My answer was that I will go ahead with the purchase if they can close in November, if they cannot then I do not want the house unless they can reduce the purchase price and pay for the associated costs so that I don't bleed money. The important thing is that it would be good to know that the sellers are not ready to reduce the price beyond November in which case I can ask for the deposit back right now. But if they are ready to accept my terms, I guess I have to modify the contract right ?
We like the house, but we are not at the point where we can be emotionally blackmailed into getting into it at any cost. So I wanted a date beyond which I can ask my deposit back if I chose to, and thats where the attorney was not clear. I am going to follow up with him tomorrow, will keep you posted. Tell your attorney what your additional terms are and have him add a rider stating them and submit it to the seller's attorney for their immediate signature. If they balk, then you know you might as well bail.
We just heard today that the house was inspected and everything was in order and they are going to get the CO's shortly, funny how it got done in just a day.... maybe because I verbally told them that I'm inclined towards backing out ???? ....
