Kindergarten in NY is not mandatory. Is that correct?
If that is correct, and I am paying to send my child to parochial Kindergarten, isn't that daycare? Can't I write the tuition off since it is elective? Legally, what constitutes Kindergarten?

I would think a legal kindergarten would have to be certified by the state and have certified teachers as well. Ask the school.

U can only write off pre-school if you are using it for daycare...Kindergarten is not pre-school, therefore u cannot write it off on your taxes.....

What makes Kindergarten Kindergarten?
My son is at the same place he was at for preschool, only this year he qualifies for a full day. It is titled "Kindergarten." What does that mean, and what must it mean to warrant an audit?

Interesting. Kindergarten is not required. I suppose you could chance it and hope you don't get audited. Can't imagine that would be a flag if you've been writing it off the last few years at the same place. Parochial school might be a tip off though.

Yeah kinda stinks, my CPA says you can't deduct Kindergarten. And its true, Kindergarten is not mandated by NYS.
