I came home to my apartment today and while attempting to park in a handicapped space, I notice there is a cone blocking the space. I then ask the parking attendant may I park there. He says something like, "the lady went to the store and she will be right back".

My question is, is it illegal to block access to a handicapped parking space in this manner?

The parking office for the building is closed for the day and I would like advice on how to handle this with the manager in the morning. Thanks

Regarding handicapped parking spaces, California Vehicle Code Section 22507.8 states:

(b) It is unlawful for any person to obstruct, block, or otherwise bar access to those parking stalls or spaces except as provided in subdivision (a).

Subdivision (a) is not relevent in this situation.

Give a copy of this to management, as they may not be aware that what the attendant did was illegal and subject to citation.

We live in a APT complex in a unincorporated area of Clarendon Hills, Il. There is not one handicapped parking space for any of the bldgs. Is this against the law? How does someone fix this problem.

I'd say you first need to determine if handicapped parking spaces are even required at apartment buildings in your town. Place a call to the City or County government offices.
