We have 3 people living in the house. Only 1 person is on the lease with the landlord. The other 2 are sub-leasing and have a month-to-month lease that states "the subleasor or subleassee must give a 30 day notice to move out".

However, since we in Los Angeles, and rent control laws state that you can't evict someone unless you have one of 12 reasons, do those rules only apply to LANDLORD/tenant leases, or also to subleases between tenant? May we give a 30 day notice to the person who is living in the house, and signed the sub-lease, but is NOT on the lease with the landlord?

Any help would be great! Thank you!

Sounds like you may need to talk to an attorney.

Month-to-month lease? Is there such a thing?

Does the owner/landlord know of the sublease and subleasees?

Los Angeles has rent control, but not all housing in Los Angeles is governed by the rent control laws. I think your first step is to determine whether the house you live in is even governed by the rent control law. It might not be. You might want to contact the Housing Authority at 2600 Wilshire Blvd. (I believe that they help people at the counter) or call them at (213) 252-5370 or call the hotline for Rent stabilization - Tenant rights - landlord hotline at (800) 994-4444. Also, as was previously mentioned, either the tenancy is governed by a lease which is for a set term (six months, a year, etc.) or it is governed by a month-to-month rental agreement. If the lease has expired and no new lease has been signed, my understanding is that this becomes a month- to -month rental agreement but you should check with a landlord tenant attorney to make sure this is accurate.
