I wonder if he's even been through Skid Row or East Hollywood or the other many areas of the city where the homeless have taken over the streets , shopping carts and everything else with their belongings...why are the 'homeless' allowed to leave litter and trash...but if someone else does it it's considered littering with a big fine?..

A federal judge issued a preliminary injunction today barring Los Angeles police and sanitation officers from seizing and destroying homeless people’s property without sufficient notice.

U.S. District Court Judge S. James Otero also ordered the city to segregate and store impounded belongings where they can be recovered, the Los Angeles Times reported.

The city will be allowed to confiscate or destroy contraband, crime evidence and hazardous material or rat-infested property posing public health and safety issues, Otero ruled, according to The Times.

The injunction applies to skid row and “adjoining areas,” the Times reported.

The City Attorney’s Office is evaluating the court’s order, Rob Wilcox of the City Attorney’s Office told City News Service.

Shayla R. Myers, a staff attorney with the Legal Aid Foundation of Los Angeles said, “The court’s order makes it clear that the city cannot keep putting homeless people’s lives in jeopardy by taking and throwing away their tents, blankets, medication, and other items they need to survive.”

“The court recognized, yet again, that the United States Constitution protects homeless individuals’ property, and that the protection of these rights is critically important for individuals who are compelled to sleep on the sidewalks in Los Angeles,” Myers said.

Four homeless individuals and two groups sued the city last month, alleging enforcement sweeps of homeless encampments have led to false arrests and property seizures without due process.

I still don't understand the public good being served with homeless people camping out at the parks all day. Thank another judge for that one. At least LA is not Portland. The homeless people practically run that town. I wouldn't be surprised to hear they have their own union.

You guys someone misreading the judge's statement. He did not say officers could never remove or impound the property of homeless people. He said they had to have NOTICE.

Say a homeless person is sleeping in their tent and the cops tell them to clear out. The homeless person has to have a chance to get any essential supplies they may have in their, including medication out.

Also if the police were allowed to arrest homeless people in mass, what could would putting all those people in jail do? The US already has more people locked up in prison than China and India, and both nations have over one billion people. Clearly state and federal governments have to address the root causes of homelessness.

What will happen of course is that cops just won't bother doing anything and things will just get worse . Cops can only do what they are told , and it's clear the message from their higher ups is to not do anything about the situation .

As for already having people in jail , if they break a law I think they should be in jail , homeless or not .

It sounds great to just let the homeless to what they want . But would you want homeless camped out right in front of your house or business ? Would you want to clean up after their mess?
