I'd think something like this could easily happen here, given all the mentally imbalanced people in addition to the homeless in this city.

highly unlikely with the unconstitutional gun laws in CA. TN is one of 40 states where any law abiding citizen get get a concealed carry permit. In CA, law abiding citizens have to risk serious jail time if they want to carry

if indeed she was threatened, the threat vanished the moment she was able to get on her Porche. she could have fled already, safe. but she decided to settle the argument with a bang

She was outside of her car when the homeless guy threatened to kill her. I would have shot him too

nobody is disputing that. but once she is inside her car, she can either speed away or grab her gun, get off and shoot him. am not a lawyer but its hard to justify that as a self defense


but then again, she will be tried by her peers so she could still get away with it

from the TN self defense law:

"Notwithstanding § 39-17-1322, a person who is not engaged in unlawful activity and is in a place where the person has a right to be has no duty to retreat before threatening or using force against another person when and to the degree the person reasonably believes the force is immediately necessary to protect against the other's use or attempted use of unlawful force."

No, in California, the homeless person would sue (represented by, say, Gloria Alred):
  • his shooter,
  • the city where the shooting took place (for not having given him a home and thus putting him in contact with the shooter), and
  • the county for not giving him the "medications" that he needs and deserves(had they given him his drugs he would have happily been passed out on his own sofa with a needle in his arm).
He would be awarded 10m and he'd be back on the street within 4 years.
