I rented a space (illegal attachment to garage) from an aunt of mine here is los angeles, ca. I have all my receipts for the 7 1/2 months that I lived there. She told me last week that she didnt think the arrangement was working out and that she wanted me and my 3yr old to leave. I excepted her decision. She also purchased a vehicle for me which is the reason I moved there (to save money because I was acquiring a new bill), which she also took back from me. The moving process was brutal and I am also with out a car. She has sent a certified letter to my place of employment stating that I have to vacate the premises as of 7-23-09. This letter is dated 6/11/09 and I have since vacated as of 6/13/09. I had to leave my refrigerator there because it didnt fit in the door, and she wouldnt open the garage so that i could remove it properly. Now she wants me to pay for any items that she has to have taken by waste management. I would like to know what my rights are if I have to take her to court as that seems to be where we are headed.

I am a little confused? You were paying for the car but she bought it for you? It was your fridge but she wouldn't wouldn't open the garage door so you could remove it? You were renting an illegal apartment? I don't know what you mean by your rights, do you just want to get your fridge back, did you leave a lot of stuff behind? All I can think would be to go to small claims court and see what happens. If the fridge isn't a big deal, just forget it and go on your way. I don't think she can force you to pay the fees for hauling things away especially if the rental is illegal, not to mention she would have to prove you left them behind. Lesson learned I hope, make sure any rental agrreements are completely above board..

I bet family gatherings are a hoot with you all. Why the letter to your employer? That kind of puzzled me. If there are items that you want that you left behind, like the refrigerator, make arrangements to pick them up. As a renter she should give you the option to remove them. The reason for this is she will need to pay to dispose of them, not you. Do not give her a red cent to pay for the disposal of items that you left that you don't intend to keep, or can not keep because of your current situation. Remember this was an illegal rental unit. Would love to be in court for that case if you proceed with this.

Maybe it will make Judge Judy or something? I think the part about the employer was, she sent the letter to her place of business, not to her employer, that is how I understood it...

thank's Nita, I was thinking that the aunt was getting the employer involved and didn't understand that part. Sometimes my brain try's to hard to keep up and I need you and others to help me out. LOL

OMG, thanks guys for all of your input. To clarify a few things from my previous post, the front door of the space was too small to remove the fridge and the only way to take it out was throught a door that leads to the garage, where her precious car is stored... she flat out declined to allow me to remove it. I actually went down and sent a certified notice right back to her this past afternoon. plus I reported her to building and safety and an inspector will be out to fine her for the conversion. She is very uppity and believes that everyone is beneath her but she will see the light soon enough. Oh and btw, I am going to take her to small claims court as soon as I find out what the procedures are to do so.. wish me luck guys.

Good for you and I am sure we all wish you good luck. Whatever she has done or hasn't, she has no business keeping your fridge.

I would consult a Tenants Rights Attorney or Advocacy Group.

Its always hairy dealing with family.
