Does anyone know if apartment lease's in California automatically roll into month to month leases upon expiration of the original 12 month lease? My landlord is asking us to renew our lease, but I thought someone had told me that after our lease is up we automatically become month to month tenants and are required to notify him 30 days in advance of moving out. Does this happen automatically, or does our lease need to have language in it that specifies this?

It's automatic.
But be careful. He now can give you notice to leave(within the law), where under a lease he couldn't unless you broke certain terms of the lease or failed to pay rent.

The Landlord can increase the rent on a month to month and more than likely will, thats legal. If you don't plan to stay longer than a few more months thats fine, otherwise it might not be a bad idea to sign the lease.
Depending on your state laws, 30 day written notice to vacate on a month to month, sent certified mail, copy for yourself, to avoid being charged additional months.

It should stipulate in your lease that it automatically rolls over to a month-to-month.
